Regulatory Compliance includes compliance measures that must be put in place because of government or industry requirements. Of course, regulatory compliance often varies across industries, but one thing that remains the same is that regulations are always changing.
Emptoris Contract Management helps companies meet regulatory compliance needs through the establishment of contract templates that include all required regulatory language and are verified to meet regulatory requirements by the appropriate departments, including the legal team or the risk management office. Once these templates are established all exceptions are flagged and corrected before the contract is executed. Any deviations from standard are approved and tracked in the system.
Operational Compliance
Operational Compliance includes controls and approvals that are required for a business to maintain smooth and stable operations as it transacts business. Operational compliance extends beyond requirements that are put in place by external regulations.
Operational controls are configured in Emptoris Contract Management at the clause and term level to ensure that all operational standards are followed in the contract process.
Performance Compliance
Performance Compliance pertains to analyzing how parties to a contract perform on obligations that are described in a contract.
Performance compliance applies to measuring and tracking compliance to both "price" and "non-price" terms. Price terms such as unit price, discounts, and delivery schedules need to be measured to ensure proper purchasing system execution and to verify transactions are executed per the terms and conditions of the "Non-Price" terms such as Service Level Agreements and quality standards are more difficult to monitor since operational systems in place today do not monitor all of the terms andconditions in a contract.
